Yoga in the Gardens – Canceled

I affirm that I am freely and willingly participating in activities facilitated by the Yoga in the Gardens Program (the “Program”) hosted by The Pennsylvania State University (“Penn State”) at the Arboretum during the summer 2025. In consideration of my participation in the Program, I agree, on behalf of myself and my executors, heirs, and assigns, as follows:

1. I understand and acknowledge that participating in the Program involves certain risks, both inherent and apparent (some of which I may not fully appreciate), and that serious or grievous bodily injury (including, without limitation, disability or death), damage to personal property, or other harm could occur to me or others. I recognize that I have the option to not participate in the Program and its related activities instead of encountering these inherent risks. I knowingly and voluntarily waive all claims for damages, injuries, or death sustained by me or my property directly or indirectly in connection with my participation in the Program and I accept, incur, and assume all risks of any injuries, damages, or harm which arise during or result from my participation in the Program, even if such injuries, damages, or harm arise from the negligence of Penn State or other Program participants.

2. I hereby release, covenant not to sue, and forever discharge Penn State, its trustees, officers, directors, employees, agents, and contractors (the “Penn State Representatives”) from any responsibility or liability of any kind or nature which may arise, whether directly or indirectly, from any personal injuries, death, property damage, other harm that I may suffer or incur either directly or indirectly (collectively, “Losses”) as a result of my participation in the Program. To the fullest extent permitted by law, I hereby agree to indemnify and hold harmless the Penn State Representatives from any Losses that I may suffer arising, directly or indirectly, from my participation in the Program.
